Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the Gymtuition mobile application (the “App”), which is operated by Pridham Projects Ltd (trading as “Gymtuition”) (“we”, “us”).

By accessing or using the App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you do not have permission to use the App.

1. Health, Safety, and Medical Disclaimer

The App is intended for informational and educational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment.

  • Consult a Professional: Always consult a qualified physician, personal trainer, or healthcare provider before beginning any exercise programme, especially if you have an existing medical condition or injury.
  • No Medical Assessment: We do not assess your health, physical condition, or ability to perform exercises. You are responsible for determining whether an exercise is appropriate for you.
  • Assumption of Risk: Fitness activities involve risks including injury, illness, or death. You voluntarily assume all such risks.
  • Exercise at Your Own Risk: All instructions, demonstrations, and animations are for general guidance only. You must use proper technique, suitable equipment, and a safe training environment.
  • No Liability for Injury: Pridham Projects Ltd is not responsible for any injury, harm, or damage (direct or indirect) resulting from your use of the App or performance of exercises.
  • Stop if You Feel Pain: If you feel pain, dizziness, or discomfort, stop immediately and consult a medical professional.

2. Use of the App

You must be at least 18 years old to use the App. By using the App, you confirm that you meet this requirement.

You agree not to misuse the App, attempt to disrupt its operation, or engage in unlawful activity.

3. Accounts and Subscriptions

When creating an account, you agree to provide accurate and complete information. You are responsible for keeping your password secure.

Some features require a paid subscription. Payments are processed securely through the Apple App Store and Google Play Store. Gymtuition does not collect or store any payment information. All subscription terms, renewals, and cancellations are managed by the respective app store.

4. Intellectual Property

All content in the App, including exercise names, descriptions, routines, images, icons, animations, and software code, is owned by Pridham Projects Ltd. You may not copy, distribute, or create derivative works without written permission.

5. Limitation of Liability

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND.

PRIDHAM PROJECTS LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP.

YOUR ONLY REMEDY FOR DISSATISFACTION WITH THE APP IS TO STOP USING IT.

6. Indemnity

You agree to indemnify and hold harmless Pridham Projects Ltd from any claims, losses, damages, or legal fees arising from your misuse of the App or breach of these Terms.

7. Termination

We may suspend or terminate your account at any time if you violate these Terms, misuse the App, engage in fraudulent behaviour, or if required by law.

8. Changes to These Terms

We may update or replace these Terms at any time. The most up to date version of these Terms is always available on our website at https://gymtuition.uk/terms/. Continued use of the App means you accept the updated Terms.

9. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved exclusively in the courts of England and Wales.

11. Apple App Store Additional Terms

These Terms apply to users who download the App from Apple's App Store.

  • Acknowledgement: This agreement is concluded between you and Pridham Projects Ltd only, and not with Apple Inc. Apple is not responsible for the App or its content.
  • Scope of Licence: The licence granted to you for the App is limited to a non-transferable licence to use the App on Apple-branded products that you own or control, as permitted by the App Store Terms of Service.
  • Maintenance and Support: Pridham Projects Ltd is solely responsible for providing maintenance and support services for the App. Apple has no obligation whatsoever to furnish any maintenance or support services for the App.
  • Warranty: To the maximum extent permitted by law, the App is provided "as is" and without warranty of any kind. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price for the App where applicable. To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the App.
  • Product Claims: Pridham Projects Ltd, and not Apple, is responsible for addressing any claims relating to the App or your possession and use of the App, including:
    • product liability claims;
    • claims that the App fails to conform to legal or regulatory requirements; and
    • claims arising under consumer protection, privacy, or similar legislation.
  • Intellectual Property Claims: In the event of any third-party claim that the App or your possession and use of the App infringes intellectual property rights, Pridham Projects Ltd, and not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of such claims.
  • Legal Compliance: You represent and warrant that:
    • you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country; and
    • you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Third-Party Terms: You must comply with all applicable third-party terms of agreement when using the App.
  • Third-Party Beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
